This Policy explains how PhotoClip (“PhotoClip,” “we,” “our,” or “us”) collects, uses, processes, and protects
personal data of visitors and users of the Services. If you do not agree to this Policy or the Terms of Service,
please refrain from accessing or using the Services.
Before accessing or using any PhotoClip services, you must read, understand, and agree to both this PhotoClip
Privacy Policy (“Policy”) and our Terms of Service, available at https://www.photoclip.top/doc/terms_of_service.
By using our websites, mobile applications, or any other features or services provided by PhotoClip (collectively,
the “Services”), you acknowledge that you have read and accepted these terms and that you consent to the
collection, use, processing, disclosure, transfer, and storage of your personal data as described in this Policy.
If you are under 18 years of age (or the legal age of majority in your jurisdiction), you may use the Services
only under the supervision of a parent or legal guardian who has reviewed and agreed to this Policy and the Terms
of Service on your behalf.
- Data We Collected
- Among the types of personal data that PhotoClip collects, by itself or through third parties, there are:
Cookies (as defined below); usage data; face shape data to get face cutouts; unique device identifiers;
device information; geography/region; In-app purchases; application opens; application updates; first
launches; operating systems; email address; data communicated while using the service; country; app
information; geographic position; photo library permission; write-only photo library permission; camera
permission; purchase history, social media account information when you link our Service with a third-party
social media, such as Facebook, Google, Instagram, Twitter, and other personal data necessary for the
Service (“Personal Data” or “Data”).
- Personal Data may be freely provided by you, or, in case of usage data, collected automatically when using
of our Service.
- Unless specified otherwise, all Data requested by PhotoClip is mandatory and failure to provide this Data
may make it impossible for PhotoClip to provide its services. In cases where PhotoClip specifically states
that some Data is not mandatory, you are free not to communicate this Data without consequences to the
availability or the functioning of the Service.
- Cookies
- Cookies are small text files that uniquely identify your browser or device. We also use technologies which
are similar to Cookies, such as web beacons/pixels, log files and mobile device identifiers.
- We generally use Cookies and similar technologies for the following purposes: 1) to store users'
preferences for Service functionality; 2) to track Service usage so we can improve our service, and better
understand how people are using it; and 3) to better understand the interests of our users and our Service
visitors.
- Some Cookies and similar technologies are necessary for certain uses of the Service, and without such
Cookies, we would not be able to provide many features that you need to use the Service properly.
- Permissions We Need to Obtain
We access only the minimum data necessary to provide the requested functionality. By default, the following
permissions must be granted by you before the respective information defined in the "Data We Collected" can be
accessed. Please note that the revoking of such permissions might impact the proper functioning of
PhotoClip.
- Device permissions for Personal Data access
- Camera permission: Used for accessing the camera or capturing images and video from the device.
- Photo Library permission: Allows access to your Photo Library.
- Write-only Photo Library permission: Allows write-only access to your photo library.
- How We Use Your Data
PhotoClip works hard to protect your personal information, and will only use your Personal Data when the
applicable laws allow us to. In general, we use your Personal Data for the following purposes:
- Identification and authentication: We use your data to verify you when you use the Services.
- Operating our services: We use your data to provide our Services, process and fulfill orders, provide
customer support, and to otherwise comply with our contractual obligations to you. We (and/or any of our
third-party service providers) use your financial information to process purchases made by you. For
instance, we use artificial intelligence technology to automatically process and edit portrait and
photographs.
- Communicating with you: We use your data when we communicate with you.
- Improving our services: We use your data to understand how our services are being used and how we can
improve them.
- Exercising our rights: Where reasonably necessary, we use your data to exercise our legal rights and
prevent abuse of our service.
- Legal compliance: We use your data where we are legally required to do so, or where it is necessary for
the purposes of the legitimate interests pursued by a third party.
- Protecting your information: Where appropriate, we may anonymize, backup, and delete certain data.
- How and When We Share Your Data
- At your direction, we may share your information with social media like Facebook, or Instagram so that you
can link our Service and publish your content to those media.
- We may share your information with Service providers we use to process information on our behalf, for the
purposes we describe in this Privacy Policy. This includes AI model and image-processing service providers
that help us deliver features such as image generation, enhancement, editing, background removal, and
related AI-powered functionalities. In particular, we share the Data with the following two service

- From time to time, we may also engage other service providers which could be located in various
jurisdictions to support new photo features or optimizations. All such providers, regardless of their
location, act exclusively as our data processors under written data processing agreements that require them
to follow our documented instructions, implement appropriate technical and organizational safeguards, ensure
confidentiality and security, and provide adequate protection for cross-border transfers consistent with
applicable data protection laws.
- We share information when we believe that disclosure is reasonably necessary or appropriate to comply with
law, regulation, or legal request; to protect the safety, property, or rights of the public, PhotoClip, or
any third party; or to detect, prevent, or stop any illegal, unethical, or legally actionable activity.
- We share your Personal Data with our subsidiaries in order to provide our services to you. We require that
our subsidiaries protect your personal information consistent with this privacy policy. If we were to engage
in a merger, acquisition, bankruptcy, or other transaction that involves the transfer of the information
described in this Privacy Policy, we may share your information with the parties involved in that
transaction.
- How Do We Handle Face Data
- We may process photographs and portrait images that contain facial data solely for the purpose of
providing you with our image-editing and AI-enhancement features. When you upload an image that includes
your face, we and the service providers that assist us in delivering these functionalities may use automated
and AI-based technologies to perform operations such as face cutout, portrait enhancement, or other visual
transformations requested by you. During this process, your photographs and their associated facial data may
be temporarily cached on our cloud infrastructure or on secure servers operated on our behalf. This
temporary caching is necessary to enable real-time processing and to maintain the functionality of our
Services.
- Other than enabling these features, we do not use facial data for any unrelated purpose. In particular, we
do not use facial data to identify or verify any individual, to authenticate users, to conduct advertising
or marketing, or to build, infer, or supplement a user profile. We also do not allow any party to
re-identify individuals or reconstruct user profiles from facial data processed through the Service.
- Facial data that you upload is processed and stored on secure servers located in the United States, where
our primary infrastructure is hosted. When you use the Services from another country, your facial data will
be transferred to the United States solely to provide the editing features you request. In certain cases, we
may use third-party service providers to assist with specific processing tasks. These providers may operate
infrastructure in multiple regions. When they process facial data on our behalf, they do so strictly under
our instructions, under contractual confidentiality and data-protection obligations, and only for the
purpose of performing the user-initiated editing functions. We require that such providers implement
adequate safeguards and do not retain, use, or disclose facial data for any purpose other than delivering
services to us, including prohibitions on using facial data to train their models. We do not store facial
data in any other location besides the United States on our own systems, and we do not permit service
providers to transfer facial data to any jurisdiction except as necessary to deliver the Services described
in this Policy.
- To provide a seamless editing experience, the photographs you submit—and the facial data contained within
them—may remain stored for a brief and limited period, not exceeding 7 days after your last interaction with
the image. This limited retention enables you to revisit or continue your edits. After this period, all
facial data and any intermediate processing data are permanently deleted or irreversibly de-identified. You
may also delete your photographs at any time within the app. When you do so, the associated facial data will
be promptly removed from our systems.
- We process facial data only at your direction and only to perform the editing tasks you initiate. We do
not retain facial data longer than necessary to provide the requested functionality, and we delete or
irreversibly de-identify such data once it is no longer required for these limited purposes. We also require
all service providers involved in processing facial data to act strictly under our instructions, maintain
adequate security measures, and comply with applicable data protection laws.

services to us, you may refer to their respective privacy policies.
- Your Choices and Rights
- Your Choices:
- You can at any time request to opt out from allowing us to send you push notifications by adjusting the
permissions in your mobile device.
- You can switch off camera or other similar functions on your mobile device if you do not wish to share
them.
- You can choose not to provide us with Personal Information, but that may result in you being unable to use
certain features of Services because such information may be required.
- Your Rights:
- You have the right to withdraw consent you have previously given to the processing of your Personal
Data.
- You have the right to object to the processing of their Data if the processing is carried out on your
consent other than a legal basis.
- You have the right to learn if Data is being processed, and obtain disclosure regarding certain aspects of
the processing.
- You have the right to verify the accuracy of your Data and ask for it to be updated or corrected.
- You have the right, under certain circumstances, to restrict the processing of your Data.
- You have the right, under certain circumstances, to obtain the erasure of your Data.
- You have the right to receive your Data in a structured, commonly used and machine readable format and, if
technically feasible, to have it transmitted to another controller without any hindrance. This provision is
applicable provided that Data is processed by automated means and that the processing is based on your
consent.
- You have the right to bring a claim before competent data protection authority.
- Data Security
- We use reasonable and appropriate information security safeguards to help keep the collected information
secure and to secure it from accidental loss and unauthorized access, use, alteration and disclosure.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our
best to protect your collected information, we cannot guarantee the security of the collected information
transmitted to or through PhotoClip or an absolute guarantee that such information may not be accessed,
disclosed, altered, or destroyed. Please understand that there is no ideal technology or measure to maintain
100% security.

- Other Important Information
- Subject to applicable laws and regulations and the fulfillment of our business or legal purposes, we will
retain your information (including your personal information) for such period as is required for us to
continue to provide you with our Services.
- We do not knowingly collect personal information from children under 18 years old, unless permitted to do
so by applicable law. If we become aware that we have unknowingly collected personal information from a
child, we will make commercially reasonable efforts to delete such information in our database. If you are a
parent or guardian of a child, and you believe your child has provided us with their Personal Information on
our Services, please contact us immediately at photoclip.top@gmail.com.
- We operate worldwide, and we may move, process, and store your data in any country where we operate, which
may be outside the country where you live. Not all data protection laws are the same. Some countries where
we transfer Personal Data may allow government authorities greater access than your country does.
- We are not responsible for the practices employed by websites or services linked to or from the Service,
including the information or content contained therein. Please remember that when you use a link to go from
the Service to another website, our Privacy Policy does not apply to third-party websites or services. Your
browsing and interaction on any third-party website or service, including those that have a link or
advertisement on our website, are subject to that third party’s own rules and policies. In addition, you
acknowledge that we are not responsible for and we do not exercise control over any third parties that you
authorize to access your content. If you are using a third-party website or service (like Facebook) and you
allow such a third party access to your content you do so at your own risk. This Privacy Policy does not
apply to information we collect by other means (including offline) or from other sources other than through
the Service.
- Residents in the European Economic Area, the United Kingdom, and Switzerland
If you reside in the European Economic Area (“EEA”), the United Kingdom (“UK”), or Switzerland (collectively,
the “Designated Countries”), the following provisions apply in addition to the rest of this Policy.
- PhotoClip acts as the data controller for the processing activities described in this Policy. For any

- We process Personal Data only where we have a lawful basis for doing so under applicable data protection
laws. Depending on the nature of your interaction with the Service, we may rely on your consent (including
for the upload and processing of photographs that contain facial data), the performance of a contract (to
provide the features you request), our legitimate interests (such as ensuring the security and proper
functioning of the Service), or compliance with legal obligations.
- Your Personal Data may be transferred to and processed in countries outside the Designated Countries. When
we transfer Personal Data internationally, we do so in accordance with applicable law, ensuring appropriate
safeguards are in place, including the use of European Commission–approved Standard Contractual Clauses or
other lawful transfer mechanisms.
- Your Rights:
If you are a resident of the Designated Countries, you have the right to:
- Access your Personal Data and obtain information about its processing.
- Rectify inaccurate or incomplete data.
- Request erasure of your Personal Data, subject to certain limitations.

for verification solely for this purpose.
- California Residents
- If you are a resident of California, the following rights apply to you in addition to the rest of this
Policy. These rights are available to you under the California Consumer Privacy Act (“CCPA”), as amended by
the California Privacy Rights Act (“CPRA”).

require you to provide information that allows us to confirm your identity in our systems. If applicable, we
may also request proof of California residency
- You may authorize an adult acting on behalf of a minor under your parental authority to submit a
verifiable request on the minor’s behalf. California residents may submit up to two verifiable requests
within any 12-month period.

We may change this Privacy Policy from time to time to reflect our current practices and ensure compliance
with applicable laws, so please check back frequently for changes. If we make material changes, we may notify
you through other methods as required by law. If you continue to use PhotoClip after those changes are in
